Booking Treatment Terms and Conditions

At Sidmouth Restorative Therapy, your appointment time is reserved exclusively for you. To ensure all patients have access to timely appointments and to minimise disruption to the practice, the following Booking and Cancellation Policy applies to all appointments.


1. Late Arrivals

1.1 We understand that delays can occasionally occur. However, if you arrive more than 25 minutes after your scheduled appointment time, there may be insufficient time to provide safe and effective treatment.


1.2 Appointments where a patient arrives more than 25 minutes late may be treated as a missed appointment.


1.3 The practitioner reserves the right to charge up to 100% of the scheduled appointment fee where an appointment cannot reasonably proceed due to late arrival.


2. Cancellations and Rescheduling

2.1 Patients are required to provide a minimum of 48 hours' notice to cancel or reschedule an appointment.


2.2 Appointments cancelled or rescheduled with 48 hours' notice or more may be rearranged without charge.


2.3 Appointments cancelled or rescheduled with less than 48 hours' notice may be charged up to 100% of the scheduled appointment fee.


2.4 Requests to reschedule are treated in the same manner as cancellations because the original appointment time is released and may no longer be available to another patient.


2.5 The practitioner reserves the right to charge up to 100% of the scheduled appointment fee where insufficient notice is given and the appointment cannot be reallocated.


2.6 Where an appointment is successfully reallocated to another patient, the practitioner may, at their sole discretion, reduce or waive any cancellation charge.

 


3. Appointments Booked Within the 48-Hour Notice Period

3.1 Patients may request appointments that take place within the standard 48-hour cancellation period, subject to availability.


3.2 By accepting a short-notice appointment, the patient acknowledges that the standard cancellation notice period cannot apply because the appointment has been requested within that timeframe.


3.3 If a patient subsequently requests to cancel or reschedule a short-notice appointment, the practitioner reserves the right to charge up to 100% of the scheduled appointment fee, unless the appointment can be successfully reallocated or the practitioner decides otherwise.


4. Weekend and Bank Holiday Appointments

4.1 The required notice period is calculated as 48 continuous hours before the scheduled appointment time and includes weekends and Bank Holidays.


4.2 Patients may leave a voicemail, send an email or submit an online cancellation outside normal opening hours. The time and date the message is received will be used to determine whether sufficient notice has been given.


Examples:

  • A Monday 9:00 am appointment should be cancelled by 9:00 am on Saturday.
  • A Tuesday 2:00 pm appointment should be cancelled by 2:00 pm on Sunday.
  • A Friday 3:00 pm appointment should be cancelled by 3:00 pm on Wednesday.


5. Missed Appointments

5.1 A missed appointment includes:

a) Failure to attend a scheduled appointment.

b) Failure to notify the practice that you are unable to attend.

c) Arrival more than 25 minutes after the scheduled appointment time (see Section 1).


5.2 Missed appointments may be charged up to 100% of the scheduled appointment fee.


6. Patient Responsibility and Acceptance of Terms

6.1 When booking an appointment with Sidmouth Restorative Therapy, whether online, by telephone, email, text message, social media, in person or directly with the practitioner, the patient is deemed to have accepted the current Terms and Conditions, including this Booking and Cancellation Policy.


6.2 It is the patient's responsibility to read these Terms and Conditions before making a booking.


6.3 The method by which an appointment is booked does not affect the applicability of this Booking and Cancellation Policy.


7. Patient-Initiated Cancellations and Rescheduling

7.1 Appointments cancelled or rescheduled with less than the required notice period, for reasons within the patient's control, may be subject to a cancellation charge.


7.2 Reasons within the patient's control include, but are not limited to:

a) Changes in personal preference.

b) Choosing to seek treatment from another healthcare provider.

c) Work commitments.

d) Social engagements.

e) Travel arrangements.

f) Childcare arrangements.

g) Non-emergency personal circumstances.


7.3 A patient's decision to seek treatment elsewhere, postpone treatment, change their mind or no longer require treatment does not waive the requirements of this policy where the required notice period has not been provided.


8. Exceptional Circumstances

8.1 Sidmouth Restorative Therapy recognises that genuine emergencies and unforeseen circumstances may arise.


8.2 The practitioner may reduce or waive a cancellation charge where, having considered the individual circumstances, it is reasonable and appropriate to do so. Relevant considerations may include the nature of the circumstances, the amount of notice provided, whether the appointment was successfully reallocated and the financial loss actually incurred by the practice. 


8.3 The practitioner reserves the right to reduce or waive any cancellation charge at their sole discretion.


8.4 Any discretion exercised in one instance shall not constitute a waiver of this policy or create an entitlement or expectation of future exceptions.


9. Outstanding Fees

9.1 Sidmouth Restorative Therapy reserves the right to require payment of any outstanding cancellation or missed appointment fees before accepting future bookings.


9.2 Failure to settle outstanding fees may result in future appointments being declined until the account has been brought up to date.

 

9A. Booking Reservation Payment


9.A.1 Purpose

Sidmouth Restorative Therapy recognises that appointment times are reserved specifically for individual patients and that repeated cancellations, rescheduling or non-attendance can result in appointment time being unavailable to other patients and financial loss to the practice.

To protect reserved appointment time and support the effective management of the clinic diary, Sidmouth Restorative Therapy may require certain patients to make a 50% Booking Reservation Payment as a condition of accepting or confirming future appointments.


9A.2 When a Booking Reservation Payment May Be Required

A Booking Reservation Payment will not apply automatically to all patients.

Sidmouth Restorative Therapy may require a 50% Booking Reservation Payment where, following a reasonable review of the patient's individual booking or payment history, the practice considers that an advance payment is proportionate and appropriate.

Relevant circumstances may include:

a) Repeated cancellations.

b) Repeated rescheduling or changes to reserved appointments which have caused significant disruption to the clinic diary.

c) Previous cancellations made with less than the required 48 hours' notice.

d) Previous missed appointments or non-attendance.

e) Repeated late arrival resulting in appointments being unable to proceed.

f) Previous outstanding cancellation or missed appointment charges.

g) A pattern of appointment changes which has resulted in reserved clinic time being lost or being difficult to reallocate.

The requirement will be based upon the patient's individual booking history and the legitimate operational and financial interests of the practice.

It will not be imposed arbitrarily or on the basis of any protected characteristic.


9A.3 Practice Discretion

The decision to introduce a Booking Reservation Payment remains at the discretion of Sidmouth Restorative Therapy, exercised reasonably and having regard to the patient's individual booking history.

Where the requirement is introduced, the patient will be informed before any affected future appointment is confirmed.

The requirement applies only to future appointments offered after the patient has been notified and will not retrospectively alter the payment terms of an appointment which has already been confirmed.


9A.4 Amount and Purpose of the Payment

The Booking Reservation Payment will normally be 50% of the scheduled appointment fee.

The Booking Reservation Payment:

a) Forms part of the normal price of the appointment.

b) Is not an additional fee or surcharge.

c) Will be deducted from the total amount payable for the appointment.

d) Secures the appointment time specifically reserved for the patient.

The remaining balance of the appointment fee will normally become payable following treatment unless otherwise agreed.


9A.5 Confirmation of Appointment

Where a Booking Reservation Payment is required, an appointment may be offered provisionally but will not be regarded as confirmed until the required payment has been received.

The patient will be advised of any payment deadline when the appointment is offered.

If the Booking Reservation Payment is not received within the stated period, Sidmouth Restorative Therapy may release the appointment time for booking by another patient.


9A.6 Cancellation or Rescheduling With 48 Hours' Notice or More

Where the patient cancels or reschedules the appointment with at least 48 continuous hours' notice, no cancellation charge will normally apply.

The Booking Reservation Payment may, at the patient's choice:

a) Be transferred to a replacement appointment; or

b) Be refunded.

Any replacement appointment may continue to be subject to the Booking Reservation Payment requirement.


9A.7 Cancellation or Rescheduling With Less Than 48 Hours' Notice

Where an appointment is cancelled or rescheduled with less than the required 48 hours' notice, the Booking Reservation Payment may be applied towards any cancellation charge properly due under the Booking and Cancellation Policy.

The Booking Reservation Payment does not create an additional cancellation charge.

Where a cancellation charge exceeds the Booking Reservation Payment already received, the patient may be required to pay the remaining balance in accordance with the Booking and Cancellation Policy.

The total amount retained or charged will not exceed the amount reasonably attributable to the practice's direct net loss arising from the cancellation, taking into account any appointment fee already received, any costs avoided and whether the appointment time has been successfully reallocated.

Sidmouth Restorative Therapy will not seek to recover twice for the same financial loss.


9A.8 Missed Appointments

Where a patient fails to attend a confirmed appointment, the Booking Reservation Payment may be applied towards the missed appointment charge in accordance with Section 5 of this Booking and Cancellation Policy.

Where any additional amount remains payable, this will be calculated in accordance with the applicable missed appointment provisions.


9A.9 Reallocation of the Appointment

Where a cancelled appointment is successfully reallocated to another patient, any cancellation charge will be reviewed to reflect the loss actually avoided by the practice.

Where reallocation means that part or all of the financial loss has been recovered, the cancellation charge will be reduced accordingly and any excess amount retained from the Booking Reservation Payment will be refunded.


9A.10 Cancellation by Sidmouth Restorative Therapy

Where Sidmouth Restorative Therapy cancels an appointment, the patient will not incur a cancellation charge.

Any Booking Reservation Payment relating to that appointment will, at the patient's choice:

a) Be refunded in full; or

b) Be transferred in full to a replacement appointment.

Nothing within this section affects the provisions relating to Force Majeure contained within the General Terms and Conditions.


9A.11 Exceptional Circumstances

Requests relating to genuine emergencies or exceptional unforeseen circumstances will continue to be considered fairly and reasonably in accordance with Section 8 of this Booking and Cancellation Policy.

The existence of a Booking Reservation Payment does not prevent Sidmouth Restorative Therapy from reducing or waiving a cancellation charge where it is reasonable and appropriate to do so.


9A.12 Reasonable Adjustments and Statutory Rights

Nothing within this Booking Reservation Payment Policy is intended to exclude or restrict any statutory rights.

Sidmouth Restorative Therapy will consider its obligations to make reasonable adjustments where applicable under the Equality Act 2010.

Any request for a reasonable adjustment will be considered according to the individual circumstances.


9A.13 Review of the Requirement

A requirement to make Booking Reservation Payments need not remain in place indefinitely.

Sidmouth Restorative Therapy may review the requirement following a period of reliable appointment attendance and may remove it where the additional booking safeguard is no longer considered necessary.

Removal of the requirement for one or more appointments does not prevent it from being reintroduced in the future where subsequent booking history reasonably justifies doing so.


9A.14 Acceptance

Where a patient has been notified that a Booking Reservation Payment is required, payment of the Booking Reservation Payment and confirmation of the appointment constitutes acceptance of these Booking Reservation Payment Terms together with the wider Booking and Cancellation Policy.

The patient will be given reasonable opportunity to read the applicable Terms and Conditions before payment and confirmation of the appointment.


10. Agreement

10.1 By booking an appointment with Sidmouth Restorative Therapy, whether online, by telephone, email, text message, social media, in person or directly with the practitioner, the patient confirms that they have read, understood and agreed to this Booking and Cancellation Policy.


10.2 This Booking and Cancellation Policy forms part of the Practice Terms and Conditions and applies to all appointments unless otherwise agreed in writing by Sidmouth Restorative Therapy.


 

11. Respectful Behaviour and Communication

11.1 Sidmouth Restorative Therapy is committed to providing a safe, respectful and professional environment for all patients and staff.


11.2 Patients are expected to communicate with courtesy and respect at all times, whether in person, by telephone, email, text message, social media, online messaging platforms or any other form of communication.


11.3 Sidmouth Restorative Therapy will not tolerate behaviour that is abusive, aggressive, threatening, intimidating, discriminatory, harassing, defamatory or persistently unreasonable. This includes, but is not limited to:

  • Offensive or insulting language.
  • Personal attacks or derogatory remarks.
  • Repeated or excessive communications after a matter has been addressed.
  • Threatening, intimidating or coercive behaviour.
  • Behaviour that undermines the safety, wellbeing or professional integrity of the practitioner.


11.4 Where such behaviour occurs, Sidmouth Restorative Therapy reserves the right to:
a) End the consultation or communication immediately.
b) Decline or discontinue treatment.
c) Cancel any future appointments.
d) Refuse future bookings.
e) Retain copies of all relevant correspondence and communications as part of the patient's clinical and administrative records.


11.5 Where appropriate, matters involving threatening behaviour, harassment, discrimination, malicious allegations or other unlawful conduct may be referred to the appropriate authorities, professional advisers or legal representatives.


11.6 The practitioner reserves the right to end the therapeutic relationship where mutual trust, respect and confidence have broken down and it is no longer considered appropriate to continue providing care.

By accessing this website or placing an order, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.


1. Business Identity

1.2. Sidmouth Restorative Therapy is the current trading name of R J Parker Sports & Remedial Therapy. 


1.3. The business continues to be owned and operated by Rebecca J Parker and there has been no change in ownership, management or legal responsibility.


1.4. References throughout these Terms & Conditions to R J Parker Sports & Remedial Therapy include Sidmouth Restorative Therapy, where applicable.


1.5. All gift vouchers, prepaid treatment packages, treatment credits, loyalty balances, plastic gift cards and purchases previously issued or purchased under R J Parker Sports & Remedial Therapy remain fully valid and redeemable through Sidmouth Restorative Therapy, subject to their original terms, validity periods and applicable policies.


1.6. The change of trading name does not affect any existing contractual rights, consumer rights or obligations.


2. About Us

2.1. Sidmouth Restorative Therapy is a UK-based manual therapy practice providing Sports Therapy, Clinical Manual Therapy, Remedial Therapy, Soft Tissue Therapy, Reflexology, rehabilitation services and selected retail products.


2.2. The Sidmouth Restorative Therapy Online Store provides gift vouchers, prepaid treatment packages, treatment credits and selected retail products.

Payments are processed securely using SumUp.


2.3. Clinical administration and patient records are securely managed using Cliniko Practice Management Software in accordance with UK GDPR, the Data Protection Act 2018 and applicable professional standards.


3. Website Use

3.1. The content of this website is provided for general information only.

Sidmouth Restorative Therapy reserves the right to amend website content, pricing, products, services or policies at any time without prior notice.


3.2. Continued use of this website constitutes acceptance of any revised Terms & Conditions.


3.3. Users are responsible for ensuring their own devices are protected against viruses or malicious software.


4. Formation of Contract


4.1. A legally binding contract is formed only when:

  • A physical product has been dispatched; or
  • A confirmation email has been issued for a gift voucher, prepaid treatment package or other prepaid service.


4.2. By placing an order you confirm that:

  • You are aged 18 years or over.
  • You have the legal capacity to enter into a binding contract.
  • The information supplied is accurate and complete.


4.3. Sidmouth Restorative Therapy reserves the right to refuse or cancel any order at its discretion.


5. Prices and Payment

5.1. All prices are displayed in Pounds Sterling (£).

5.2. Payments are processed securely via SumUp.

5.3. Payment for a voucher, prepaid treatment package or service does not 5.4. constitute an appointment booking.

5.4. Appointments must be booked separately and remain subject to practitioner availability.

5.5. Prices may be amended at any time prior to purchase.


6. Delivery and Digital Fulfilment

Physical Products

6.1. Physical products will be dispatched to the delivery address supplied during checkout.


6.2. Once dispatched, Sidmouth Restorative Therapy accepts no responsibility for delays, loss or damage caused by third-party postal or courier services.


6.3.Digital Purchases

6.4. Gift vouchers, prepaid treatment packages and treatment credits are fulfilled electronically.


6.5. Confirmation by email constitutes proof of delivery.


6.6. Where the recipient is an existing patient, the purchase will be applied to their Cliniko patient record.


6.7. Where the recipient is a new patient, a patient record will be created upon first booking in accordance with UK GDPR requirements.


6.8.Application of credit to a patient record does not constitute an appointment booking.


7. Consumer Rights and Cooling-Off Period

7.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, most online purchases may be cancelled within 14 days.


7.2. Physical Products

7.3. Returns are accepted within 14 days of receipt provided the item is:

  • Unused
  • In its original packaging
  • In a resaleable condition

7.4. Unless the item is faulty, return postage remains the responsibility of the purchaser.


7.5. Gift Vouchers and Prepaid Treatment Packages

7.6. A full refund may be issued within 14 days where the voucher or package has not been used or redeemed.


7.7. Where treatment has been booked or provided at the customer's request during the cooling-off period, cancellation rights may be reduced or waived in accordance with consumer legislation.


7.8.Refunds will be processed to the original payment method within 14 days of approval.


7.9. Following expiry of the cooling-off period, prepaid treatment packages are non-refundable except where required by law.

Where any treatment session within a prepaid package has been redeemed:


  • 7.9.2. Completed treatments remain non-refundable.


  • 7.9.3. Remaining sessions remain non-refundable unless otherwise required by law.


7.10. Refund requests may only be made by the original purchaser.


7.11. Recipients of gifted vouchers or treatment packages are not entitled to request refunds.


8. Gift Vouchers and Prepaid Treatment Packages

Definition

8.1. A prepaid treatment package consists of:


  • 8.1.2. A fixed number of treatment sessions;


  • 8.1.3. Purchased together as a single transaction;


  • 8.1.4. Usually offered at a discounted overall price;


  • 8.1.5. Subject to a stated validity period.


8.2. Validity

8.3. Gift vouchers purchased on or after 16 February 2026 are valid for 24 months from the date of purchase.


8.4. Gift vouchers purchased before this date remain subject to the Terms & Conditions in force at the time of purchase.


8.5. Unused balances remaining after expiry are forfeited.


8.6. Expiry dates form part of the contractual agreement.


8.7. Extensions will not normally be granted except where required by law.


8.8. Requests for extension must be submitted in writing before the expiry date.


8.9. Redeeming Vouchers

8.10. Voucher use must be declared when booking.


8.11. Presentation may be by:

  • 8.11.2. Presenting the physical voucher or gift card;


  • 8.11.3. Advising the practitioner at the time of booking that payment will be made using a voucher, prepaid package or treatment credit.


8.12. Failure to notify the practice when booking may result in full payment being required at the appointment.


9. Changing a Gifted Treatment

9.1. Recipients may request an alternative treatment by contacting:

9.2. Where the replacement treatment:

  • 9.2.2. Costs less than the gifted treatment, no refund will be given.


  • 9.2.3. Costs more than the gifted treatment, the price difference must be paid before treatment.


9.3. Gift vouchers cannot be exchanged for cash.


10. Plastic Gift Cards

10.1.Previously issued biodegradable plastic gift cards remain valid until their stored balance has been exhausted.


10.2. Plastic gift cards:

  • 10.2.1. May continue to be used until the balance reaches zero.


  • 10.2.2. Cannot be exchanged for cash.


  • 10.2.3.Cannot be reloaded.


10.3. New plastic gift cards are no longer issued.


11. Lost Gift Vouchers or Gift Cards

11.1. If a voucher or gift card has been lost, please contact:

Please provide:

  • 11.2.1 Purchaser's name


  • 11.2.2. Approximate purchase date


11.3. Where purchase records can be verified, replacement instructions will be provided.


11.4. Where no purchase record exists, proof of purchase will be required.


11.5. Without satisfactory proof of purchase, treatment will be charged at the current rate.


12. Individual Use of Treatment Packages

12.1 Treatment packages are intended for use by one individual only.

Packages:

  • 12.1.1. Cannot be shared.


  • 12.1.2. Cannot be divided between multiple individuals.


  • 12.1.3. Become non-transferable once any session has been redeemed.


  • 12.1.4. Gifted packages must be redeemed by the named recipient.


13. Cancellation and Missed Appointment Policy

Definitions

13.1. A cancellation includes any appointment cancelled, rearranged or substantially modified within 48 hours of the scheduled appointment time.


13.2. A missed appointment includes:

  • 13.2.1. Failure to attend without notice; or
  • 13.2.2. Arrival more than 25 minutes late where treatment cannot reasonably proceed.

13.3. A minimum of 48 hours' notice is required.


13.4 Pay-As-You-Go Appointments

13.5. Appointments cancelled with less than 48 hours' notice will incur a charge equal to 100% of the appointment fee.


13.6. Missed appointments are charged at 100% of the appointment fee.


13.7. Outstanding balances must be settled before further appointments can be booked.


13.8. Prepaid Treatment Packages and Gift Vouchers

13.9. Appointments cancelled with less than 48 hours' notice will result in one treatment session being deducted from the prepaid package or voucher.


13.10. Missed appointments will also result in one treatment session being deducted.


13.11. Sessions deducted under the Cancellation Policy are non-refundable and cannot be reinstated.


13.12. Late arrival will reduce the available treatment time.


13.13. Appointments cannot be extended beyond the scheduled booking and the full treatment fee remains payable.


14. Faulty or Incorrect Products

14.1. If you receive an incorrect or faulty product, please notify Sidmouth Restorative Therapy within 48 hours of receipt.


14.2. Photographic evidence may be requested.


14.3. Where appropriate, a replacement or refund will be offered.


14.4. Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015.


15. Data Protection

15.1. Personal information is processed in accordance with:

  • 15.1.1. UK GDPR
  • 15.1.2. Data Protection Act 2018
  • 15.1.3. Information Commissioner's Office (ICO) guidance


15.2 Clinical and financial records are securely stored within Cliniko Practice

1. Following your Aromareflex treatment:

  • You have been provided with a product for your personal use. 
  • Please read these terms and conditions carefully.Product Description: The product provided is a personalised blend of essential oils in a base medium (massage balm), created during your Aromareflex treatment. 
  •  This product is blended specifically for you and is intended for your personal use only. It must not be shared with or given to others. 


2. Guidance and Instructions:

A leaflet will be provided with your blend, giving clear information on: 

  1. How to use the product safely. 
  2. Suitable areas of application. 
  3. Frequency of use. 
  4. What you should avoid when using the product. 
  5. You must follow the guidance provided in the leaflet at all times. 


3. Safety and Limitations

  • The product is not a licensed medicine and is provided for wellbeing purposes only. 
  • It is not intended to replace professional medical treatment, advice, or prescribed medication.
  • If you experience any adverse reaction, discontinue use immediately and seek medical advice. 
  • Do not use the product if you develop a new medical condition, skin condition, or allergy without first consulting a healthcare professional. 


4. Storage and Shelf Life

  • Store in a cool, dry place away from direct sunlight and heat. Keep the product out of reach of children and pets. 
  • The product should be used within 3 months of the date it was provided, unless otherwise stated on the leaflet or packaging. 


 5. Liability

  • R J Parker Sports & Remedial Therapy accepts no responsibility for misuse of the product or failure to follow the usage guidelines provided. 
  • By taking receipt of the product, you acknowledge that it is for your own personal use only and agree to use it in accordance with the provided instructions.


6. Booking Appointments

  • When booking the appointment for your gifted Aromareflex or Thermal Aromareflex treatment(s), please inform the practitioner that this is a gifted treatment before the appointment commences.
  • All safety, infection control and clinical procedures must be adhered to for treatment to commence.

General Terms & Conditions


1. Business Identity

1.1 Sidmouth Restorative Therapy is the current trading name of R J Parker Sports & Remedial Therapy.

1.2 The business continues to be owned and operated by Rebecca J Parker, and there has been no change in ownership, management or legal responsibility.

1.3 References to R J Parker Sports & Remedial Therapy within previous documentation, gift vouchers, prepaid treatment packages, treatment credits or agreements shall be deemed to refer to Sidmouth Restorative Therapy, where applicable.

1.4 All valid gift vouchers, prepaid treatment packages, treatment credits, gift cards and other purchases previously issued under R J Parker Sports & Remedial Therapy remain fully redeemable through Sidmouth Restorative Therapy, subject to the original terms, validity periods and applicable policies.

1.5 The change of trading name does not affect any existing contractual rights or obligations between the practice and its patients.

2. Governing Law

2.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

2.2 Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

3. Consumer Rights

3.1 Nothing contained within these Terms & Conditions, or within any associated clinic policy, shall exclude or restrict your statutory rights under applicable UK consumer legislation.

3.2 This includes, but is not limited to:

  • 3.2.1 Consumer Rights Act 2015.
  • 3.2.2 Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • 3.2.3 Consumer Protection from Unfair Trading Regulations 2008.

3.3 Should any provision of these Terms & Conditions be found unlawful, unfair or unenforceable, that provision shall be severed without affecting the validity or enforceability of the remaining provisions.

4. Clinical Suitability and Professional Discretion

4.1 All treatments and services are subject to an initial clinical assessment.

4.2 All treatments remain subject to ongoing clinical review throughout the course of care.

4.3 All clinical decisions shall be made using the professional judgement of the treating practitioner.

4.4 Sidmouth Restorative Therapy reserves the right to decline treatment where it is considered clinically inappropriate or outside the practitioner's professional scope of practice.

4.5 Sidmouth Restorative Therapy reserves the right to suspend or discontinue treatment where continuing treatment is no longer considered clinically appropriate or in the patient's best interests.

4.6 Treatment plans may be amended, modified or adapted where necessary to maintain patient safety or achieve appropriate clinical outcomes.

4.7 Patients may be referred to another suitably qualified healthcare professional where this is considered clinically appropriate.

4.8 The treating practitioner's professional judgement shall always take precedence in matters concerning patient safety.

5. Limitation of Liability

5.1 To the fullest extent permitted by law, Sidmouth Restorative Therapy shall not be liable for losses not directly arising from a breach of contract.

5.2 Sidmouth Restorative Therapy shall not be liable for indirect or consequential losses.

5.3 Sidmouth Restorative Therapy shall not be liable for loss of business, income, earnings, profits or opportunity arising from the use of its services or website.

5.4 Sidmouth Restorative Therapy shall not be liable for delays caused by circumstances beyond its reasonable control.

5.5 Nothing within these Terms & Conditions excludes or limits liability for:

  • 5.5.1 Death or personal injury caused by negligence.
  • 5.5.2 Fraud or fraudulent misrepresentation.
  • 5.5.3 Any liability which cannot lawfully be excluded or limited.

6. Force Majeure

6.1 Sidmouth Restorative Therapy shall not be liable for any failure or delay in providing services where such failure arises from events beyond its reasonable control.

6.2 Such events may include, but are not limited to:

  • 6.2.1 Serious illness or incapacity of the practitioner.
  • 6.2.2 Severe weather.
  • 6.2.3 Flooding.
  • 6.2.4 Fire.
  • 6.2.5 Structural damage to the premises.
  • 6.2.6 Government restrictions.
  • 6.2.7 Public health emergencies.
  • 6.2.8 Utility failures.
  • 6.2.9 Internet or telecommunications failures.
  • 6.2.10 Industrial action.
  • 6.2.11 Transport disruption.
  • 6.2.12 Any other event beyond the reasonable control of the practice.

6.3 Where appointments are cancelled due to Force Majeure, every reasonable effort will be made to rearrange appointments at the earliest mutually convenient opportunity.

6.4 No cancellation charges shall apply where cancellation results solely from a Force Majeure event.

7. Variations to These Terms

7.1 Sidmouth Restorative Therapy reserves the right to amend these Terms & Conditions from time to time.

7.2 Amendments may be made to reflect changes in legislation, professional guidance, business operations or clinical practice.

7.3 The version of these Terms & Conditions in force at the time a booking, purchase or contract is entered into shall apply to that transaction.

8. Complaints Procedure

8.1 Sidmouth Restorative Therapy is committed to providing a professional, respectful and high standard of care.

8.2 If you are dissatisfied with any aspect of your treatment, service or purchase, you are encouraged to contact the practice promptly.

8.5 Complaints will be acknowledged promptly.
